  The Administrative Structure of State Election Offices

As might be expected given the Constitutional mandate that the individual States conduct elections in our country, the administrative structure of election offices varies widely from State to State and region to region. The information below is intended to be used as a general reference guide for understanding the unique systems used to administer elections in the 50 States and the District of Columbia.  States are listed alphabetically and outline election administrative offices on a State, local, and precinct level, including their representative duties, terms of office, if elected, and appointing body or individual where appropriate.

(This information specifically excludes references to those bodies within each State which regulate campaign finance law/disclosure).

STATE OFFICES:

SECRETARY OF STATE-

  • Chief Election Officer, elected for four year term.

LOCAL OFFICES:

JUDGE OF COUNTY PROBATE COURT-

  • elected to 6 year term.
  • compiles and publishes list of registered voters.
  • provides ballots and supplies for all elections.

APPOINTING BOARD-

  • Judge of Probate Court, Sheriff and Clerk of the Circuit Court.
  • appoint precinct and polling place officers.

CLERK OF THE CIRCUIT COURT-

  • administers absentee voting.

SHERIFF-

  • publishes election notices.
  • transmits county returns to Secretary of State.

BOARD OF REGISTRARS-

  • three persons appointed by Governor, Auditor, and Commissioner ofAgriculture to four year term in the majority of counties (One county has four Board members, and another county has one registrar serving in a county merit position).
  • administers voter registration.

COUNTY COMMISSION-

  • Judge of Probate Court & four elected Commissioners for four year terms in 25 counties. (In 42 counties, the Chair of the County Commission is either elected county wide, elected among the Commission itself, or serves as a result of a rotating system). *The number of County Commissioners in each county range from three to seven.
  • canvass county vote for federal offices and prepare returns for transmittal to Secretary of State.

 

ELECTION DAY OFFICERS:

  • Includes; one Inspector, three Clerks, and one Returning Officer, appointed for each election.

 

 

ALASKA

 

STATE OFFICES:

LIEUTENANT GOVERNOR-

  • elected for four year term.
  • responsible for the conduct of elections and administration of state election law.
  • appoints Director of Elections.

DIRECTOR OF ELECTIONS-

  • delegated supervision of central and regional election offices in Anchorage, Fairbanks, Juneau, and Nome.
  • trains election personnel.
  • administers all state and various regional elections.
  • supervises conduct of voter registration.
  • prepares and distributes ballots.
  • prescribes minimum requirements for voting systems.
  • appoints Election Supervisors
  • responsible for statewide voter registration rolls.

LOCAL OFFICES:

ELECTION SUPERVISOR-

  • assists in administration of elections.
  • appoints precinct Election Boards.
  • appoints Judges for each polling place for state conducted elections.
  • manages voter registration rolls for jurisdictions.

BOROUGH ASSEMBLIES/CITY COUNCILS-

  • elected for three to four year terms.
  • prescribes rules for conducting municipal elections.
  • appoints Judges for each polling place for locally conducted elections.
  • state provides technical assistance and supplies VREMS data registers.

 

ELECTION DAY OFFICERS:

ELECTION BOARD-

  • at least three Judges appointed by Election Supervisors for each precinct.

RECEIVING BOARD/CONTROL BOARD/DATA PROCESSING BOARD-

  • appointed by Election Supervisor to monitor the computer counting centers.
  • ensures security of ballot box and prepares ballots for the computer.

WATCHERS-

  • appointed by the precinct/district party committee to observe the precinct counting centers.

 

ARIZONA

 

STATE OFFICES:

SECRETARY OF STATE-

  • chief election officer, elected for four year term.
  • prescribes, in consultation with counties, rules and regs. for voting and vote canvassing, publishes in official election manual.
  • canvasses votes for statewide offices and questions.
  • must approve electronic vote tabulation equipment before use.

 

LOCAL OFFICES:

COUNTY BOARDS OF SUPERVISORS-

  • three or five members elected for four year term.
  • appoints and train precinct election officials.
  • provides election supplies.
  • prints ballots.
  • tabulates and canvasses all votes cast in county.

COUNTY RECORDER-

  • elected for four year term.
  • handles voter registration.
  • handles all absentee voting, except vote tabulation.

 

ELECTION DAY OFFICERS:

ELECTION AND TALLY BOARDS-

  • Board of Supervisors appoints one Inspector, One Marshal, two Judges and not less than two Clerks nominated by the major parties.
  • Exception if 250 or less registered voters in precinct.

COUNTY PARTY COMMITTEES-

  • May appoint challengers to be at the polls on election day.

 

 

ARKANSAS

 

STATE OFFICES:

SECRETARY OF STATE-

  • elected for four year term.
  • certifies list of all state candidates to County Board of Election Commissioners.
  • certifies winners in general elections.
  • canvasses vote in statewide elections.
  • administers voter registration data base for the state.

STATE BOARD OF ELECTION COMMISSIONERS-

  • composed of Governor, Lt. Gov., Attorney General, Secretary of State, State Auditor, State Treasurer, State Land Commissioner, State Chairs of majority and minority parties, 4 citizens not holding elected office.
  • appoints 3rd member of each County Board of Election Commissioners.
  • examines & approves electronic voting systems before use.

 

LOCAL OFFICES-

COUNTY BOARD OF ELECTION COMMISSIONERS-

  • composed of county chairs of majority and minority party, and one person appointed by State Board of Election Commissioners.
  • appoints local election officials.
  • administers early voting in counties with over 150,000 registered voters.
  • prints and distributes ballots.
  • canvasses votes on county level.
  • prepares absentee ballots to deliver to County Clerk.

COUNTY CLERK-

  • elected for two year term.
  • administers registration of voters.
  • administers absentee and early voting.

 

ELECTION DAY OFFICERS:

  • 2 Clerks, 1 Election Judge, 1 Election Sheriff.

 

 

CALIFORNIA

STATE OFFICES:

SECRETARY OF STATE-

  • chief election officer, elected to four year term.
  • generally administers elections and enforces provisions of state election code, including voter registration & ballot and initiative preparation.
  • supervisory power over local election officials.

VOTING SYSTEMS PANEL-

  • Secretary of State establishes specifications for, and approves all voting machines and vote counting systems used in California elections.

 

LOCAL OFFICES:

COUNTY CLERK or REGISTRAR OF VOTERS

  • chief election officer at local level, County Clerk elected for four year term, Registrar of Voters appointed, confirmed by county Board of Supervisors for an indefinite term.
  • administers absentee voting
  • administers voter registration at the county level.
  • subject to election code, County Clerk/Registrar of Voters has authority to establish, change, or abolish election precincts.
  • appoints Inspectors, Clerks & Judges of Elections.

 

ELECTION DAY OFFICERS:

PRECINCT BOARDS-

  • Includes a minimum of one Inspector, two Clerks.
  • appointed by County Clerk/Registrar of Voters.

POLL WATCHERS-

  • appointed by political parties or candidates.

COLORADO

 

STATE OFFICES:

SECRETARY OF STATE-

  • chief election officer, elected for four year term.
  • supervises conduct of primary, general, congressional vacancy and statewide ballot issues and may issue rules and regulations to ensure proper administration and enforcement of state election law.
  • may prescribe forms required for elections.
  • supervises and inspects local election officials in the conduct of elections and voter registration.
  • canvass primary returns for federal and state legislative offices.
  • coordinates the responsibilities under the National Voter Registration Act (NVRA).

 

LOCAL OFFICES:

COUNTY CLERK AND RECORDER-

  • elected to four year term.
  • responsible for voter registration.
  • prepares all ballots.
  • selects election judges.
  • chief designated election official for all coordinated elections.

COUNTY BOARD OF CANVASSERS-

  • County Clerk and one member chosen by the county chairperson of each of the two major parties.
  • canvasses and prepare abstracts of election returns for national, state and district offices of state concern for transmittal to Secretary of State.

 

ELECTION DAY OFFICERS:

ELECTION JUDGES-

  • recommended for each precinct by the county chairperson of each major political party.
  • includes three Receiving Judges and three Counting Judges.

POLL WATCHERS-

  • political parties, candidates and issue committees may appoint one person to be at polls.

 

 

 

CONNECTICUT

 

STATE OFFICES:

Chief Elections Official-

  • Secretary of the State acts as, elected for four year term.
  • trains and advises local officials in proper methods of conducting elections.
  • distributes to electors information relating to proposed laws and amendments.
  • certifies and distributes official ballots.
  • provides absentee voting forms.
  • must approve voting machines/systems before use.

STATE ELECTIONS ENFORCEMENT COMMISSION-

  • five members appointed to five year terms by the Governor, Speaker of the House, President Pro-tempore of the Senate and the minority leaders of the House and Senate.
  • investigatory and enforcement entity.
  • must investigate all election law violations and may refer to either the Attorney General or Chief States Attorney.

 

 

LOCAL OFFICES:

REGISTRARS OF VOTERS-

  • Two elected in each municipality for two or four year terms, one from each of the two major parties.
  • responsible for voter registration and election administration.
  • appoints vote Checkers, a Head Moderator and a Moderator for each polling place.

TOWN CLERK-

  • elected for two or four year term.
  • conducts absentee voting.
  • receives ballots from Secretary of theState, inspects them for accuracy, then delivers to polling place.

 

ELECTION DAY OFFICERS:

HEAD MODERATOR-

  • appointed by registrars to tabulate town precincts

MODERATORS-

  • appointed by registrars to manage polling place.

ASSISTANT REGISTRARS OF VOTERS-

  • appointed by Registrars to regulate admission of electors.

CHECKERS-

  • appointed by registrars to check lists of electors as they enter the polling place.

VOTING MACHINE TENDERS-

  • appointed by registrars in each town or district for each voting machine.

CHALLENGERS-

  • appointed by registrars to challenge apparently ineligible voters.

 

 

DELAWARE

 

STATE OFFICES:

STATE ELECTION COMMISSIONER-

  • appointed by Governor for four year term.
  • supervises conduct of all voter registration and elections.
  • promulgates rules and regulations for the conduct of elections.
  • provides training and instruction to state and local election officials.
  • prescribes voter registration forms.

 

LOCAL OFFICES:

COUNTY ELECTION BOARD-

  • Kent and Sussex Counties = six member Boards.
  • New Castle County = ten member Board.
  • State Election Commissioner ex-officio member of each Board.
  • conducts voter registration.
  • administers primary and general elections.
  • provides instruction to local election officials.
  • furnishes election supplies to each precinct.

BOARD OF CANVASS-

  • composed of Superior Court Judges.
  • counts all votes cast in each county and verifies the results.

 

ELECTION DAY OFFICERS:

INSPECTORS, JUDGES AND CLERKS-

  • appointed by County Boards of Election for each election.

CHALLENGERS-

  • appointed to be at the polls to oversee the election process.

 

DISTRICT OF COLUMBIA

OFFICES:

DISTRICT OF COLUMBIA BOARD OF ELECTIONS AND ETHICS-

  • three members appointed by Mayor with the advice and consent of the D.C. Council for three year staggered terms.
  • conducts all voter registration.
  • conducts absentee registration and voting.
  • prescribes regulations necessary for carrying out elections and voter registration within the District.
  • operates polling places.
  • provides all Ward election materials (Bilingual when necessary).
  • counts and records all votes cast within the District.
  • certifies the results of each election.

 

ELECTION DAY OFFICERS:

  • Precinct Captains, Assistant Precinct Captains, Ballot Clerk, Special Ballot Clerks, Ballot Box Clerks, Master Index Clerks and Voting Booth Demonstration Clerks..

WATCHERS-

  • candidates and political parties select individuals to observe the elections.

 

 

FLORIDA

 

STATE OFFICES:

SECRETARY OF STATE-

  • chief election officer, elected for four year term.
  • provides guidance to Supervisors of Elections.
  • provides technical assistance to Supervisors of Elections.
  • prescribes voter registration forms and procedure.
  • prescribes rules concerning electronic voting systems.

ELECTION CANVASSING COMMISSION-

  • Governor, Secretary of State and Director of Elections (appointed by Secretary of State).
  • canvasses all county returns and prepare election abstract.

 

LOCAL OFFICES:

SUPERVISORS OF ELECTIONS-

  • chief election official at the county level, elected for four year terms.
  • appoints other local election officials.
  • administers voter registration.
  • administers absentee voting.
  • conducts poll worker training.
  • distributes election materials to each precinct.

COUNTY CANVASSING BOARD-

  • includes Supervisor of Elections, County Court Judge and Chairman of the County Board of Commissioners.
  • tabulates county vote and prepares abstracts for transmittal to the Secretary of State

 

ELECTION DAY OFFICERS:

ELECTION BOARD-

  • two Boards per precinct composed of Inspectors and Clerks appointed by Supervisor of Elections.

 

 

GEORGIA

 

STATE OFFICES:

SECRETARY OF STATE-

  • chief election official, elected for a four year term.
  • furnishes forms and election supplies to local officials.
  • canvasses all votes cast in the state for federal and non-constitutional state offices.
  • must approve all vote recorders, voting machines and voting systems.

STATE ELECTION BOARD-

  • includes the Secretary of State, one individual nominated from each of the two major political parties, one individual chosen by a majority vote of the state Senate and one individual chosen by majority vote in the state House. Except for the Secretary of State, all serve two year terms.
  • investigates election irregularities.
  • hears complaints pertaining to elections and voter registration and investigates election irregularities.

CONSTITUTIONAL OFFICERS ELECTION BOARD-

  • composed of the Speaker of the House, Clerk of the House, President Pro Tempore of the Senate, Secretary of the Senate, and the chairmen of each standing committee in the General Assembly.
  • canvasses votes, certifies election returns and publishes the election results.

 

LOCAL OFFICES:

JUDGE OF THE PROBATE COURT-

  • chief election official at county level, elected for four year term (in counties with election Boards, they assume duties of the Probate Judge).
  • canvasses returns of primary and general elections.
  • appoints poll officers and other election officials.
  • issues rules and instructions for the guidance of local election officials.

COUNTY ELECTION BOARD-

  • five members (may vary county to county).
  • performs same function as Judge of Probate Court in counties where the Probate Judge is election superintendent (Any county regardless of size/population can, by legislative Act create an Elections Board).

COUNTY BOARD OF REGISTRARS-

  • three to five members.
  • administers voter registration.
  • administers absentee registration and voting.

COUNTY BOARDS OF ELECTION& REGISTRATION-

  • perform all duties pertaining to elections and voter registration.

 

ELECTION DAY OFFICERS:

POLL MANAGERS-

  • Chief Manager and two Assistant Managers per precinct.

CLERKS-

  • "sufficient" numbers to assist managers in each election.

CUSTODIANS-

  • care for the voting machines and vote recorders.

 

 

HAWAII

 

STATE OFFICES:

CHIEF ELECTION OFFICER-

  • appointed by the elections appointment panel for four year term.
  • responsible for the maximization and equalization of registration of eligible voters throughout the state.
  • maintains data concerning registered voters, elections, apportionment and redistricting.
  • procures voting systems.
  • responsible for public education with respect to voting materials, including the dissemination of such materials in the language of non-english proficient minority groups.
  • promulgates rules and regulations governing elections.
  • certifies election results.

 

LOCAL OFFICES:

COUNTY CLERK-

  • City and County of Honolulu, the Island of O’ahu- Clerk of the Council, conducts all elections held within the city and performs voter registration functions. Appointed by City Council and serves at the pleasure of the Council.
  • County of Kauai, Islands of Kauai and Niihau- Clerk of the Council , conducts all elections in accordance with state law and performs voter registration functions. Appointed by the City Council and serves at the pleasure of the Council.
  • County of Maui, Islands of Maui, Molokai, Lanai and Kahoolawe- Clerk of the Council, conducts all elections in accordance with state law and performs voter registration functions. Appointed by the County Council and serves at the pleasure of the Council.
  • County of Hawaii, Island of Hawaii- Clerk of the Council, conducts all elections within the county, performs voter registration functions and appoints the Deputy County Clerk and Legislative Auditor with the approval of the Council. Appointed by the County Council and serves at the pleasure of the Council.

BOARDS OF REGISTRATION-

  • One Board each for the City and County of Honolulu- Island of O’ahu, County of Kauai- Islands of Kauai and Niihau, County of Maui- Islands of Maui, Molokai, Lanai and Kahoolawe, County of Hawaii, Island of Hawaii.
  • Primary function of these Boards is to hear appeals from voters in each county who have been denied the right to register or have had their registration challenged at the polls.

 

ELECTION DAY OFFICERS:

PRECINCT OFFICIALS-

  • assigned by the Chief Election Officer or his designee from lists submitted by all qualified political parties.
  • no less than three Precinct Officials per precinct.
  • duties vary with the voting system in use in the precinct.

POLL WATCHERS-

  • each qualified party may appoint one Watcher per precinct to observe the conduct of the election in that precinct.
  • observe operations at the absentee polling place.
  • point out to precinct chairperson any violations of election law.

OFFICIAL OBSERVERS-

  • at least two people, who are not of the same political party, are responsible for observing the handling of ballots.
  • responsible for observing the process within the counting center and report any deviations from the rules or procedures.

 

 

IDAHO

 

STATE OFFICES:

SECRETARY OF STATE-

  • chief election officer, elected for four year term.
  • supervises all elections and voter registration.
  • prescribes voter registration forms.
  • certifies winners of federal, state, and district elections.
  • must examine and approve all voting machines and vote tally systems.

STATE BOARD OF CANVASSERS-

  • composed of Secretary of State, State Controller and State Treasurer.
  • abstracts votes cast for all offices and announces the results.

 

LOCAL OFFICES:

COUNTY CLERK-

  • chief election official at local level, elected for four year term.
  • supervises and administers election laws under the instruction of the Secretary of State.
  • conducts training classes for local officials.
  • chief voter registration official for the county.

COUNTY BOARD OF CANVASSERS-

  • composed of the County Commissioners.
  • canvasses election returns for all county precincts.
  • certifies the results of the election and forwards the results to the County Clerk who transfers these results to the Secretary of State.

 

ELECTION DAY OFFICERS:

ELECTION JUDGES-

  • Two or more judges are selected by the County Clerk for each election.

REGISTRARS-

  • County Clerk may appoint registrars to assist in voter registration throughout the county.

 

 

 

ILLINOIS

 

STATE OFFICES:

STATE BOARD OF ELECTIONS-

  • eight bipartisan members, four from Cook County and four from the remainder of the state, appointed by the Governor in each odd numbered year for four year terms.
  • supervises the administration of registration and election laws in the state.
  • provides a uniform manual of instructions for election judges.
  • prepares and certifies ballots for proposed amendments to the state constitution or any referenda.
  • prescribes forms, notices and other supplies used in for registrations and elections.
  • filing office for nominating petitions.
  • certifies ballot for all federal, state, and multi-county offices.
  • serves as the electoral board for objections to petitions for federal, state, and multi-county offices and statewide referenda.
  • canvassing board for federal, state, and multi-county offices and statewide propositions, including amendments to the state constitution.

 

LOCAL OFFICES:

COUNTY CLERK-

  • elected for four year term.
  • responsible for the conduct of all primary, general and special elections for federal, state, and county offices and referenda in any county, or portion thereof, not having a Board of Election Commissioners.
  • responsible for the conduct of elections for all units of government located within the county.
  • filing office for nominating petitions for county offices and referenda.
  • chairman of the electoral board hearing objections to petitions for county offices and certain other units of government within the county.
  • administers voter registration.
  • administers absentee registration and voting.

BOARD OF ELECTION COMMISSIONERS-

  • three members appointed by the county circuit court for three year terms; presently created in eight municipalities and in one county.
  • for these municipalities and county, essentially assumes the registration and election responsibilities of the County Clerk.

TOWNSHIP/MUNICIPAL CLERK-

  • may administer in-person absentee voting for all elections.
  • filing office for nominating petitions for that unit of government.
  • certifies ballot for that unit of government to County Clerk or Board of Election Commissioners.
  • serves on local canvassing board.

 

ELECTION DAY OFFICERS:

JUDGES OF ELECTIONS-

  • five members are appointed in May of even-numbered years either by a County Board or a City Board of Election Commissioners to preside over each polling place during the hours of election.

POLL WATCHERS-

  • appointed by candidates, political parties, qualified civic organizations, and proponents of ballot propositions (number in polling places vary according to appointing authority and type of election).
  • credentials provided by County Clerk or Board of Election Commissioners.
  • observes the election to ensure proper administration.

 

INDIANA

 

STATE OFFICES:

INDIANA ELECTION DIVISION

  • principle election supervisory body, made up of two Co-Directors, one member of each major party nominated by the state party chairs and appointed by the Governor for four year terms.
  • prepares paper ballots for statewide elections.
  • prepares voter registration material.
  • trains and supervises local election officials.
  • canvasses county returns in general elections.
  • must approve voting machines/systems before use.
  • canvasses election returns in primary and general elections.

 

LOCAL OFFICES:

COUNTY ELECTION BOARDS-

  • composed of Clerk of Circuit Court and one member of each major political party nominated by the county party chairs and appointed by the Clerk.
  • conducts all city and county elections.
  • appoints precinct level election officials nominated by the parties.
  • prepares ballots for city and county elections.
  • canvasses county vote.

CLERK OF THE CIRCUIT COURT-

  • acts ex-officio as county registration officer in counties without a Board of Registration.

BOARD OF REGISTRATION-

  • administers voter registration in counties with populations of 125,000 or more (optional in counties with populations less than 125,000).

 

ELECTION DAY OFFICERS:

PRECINCT ELECTION OFFICERS-

  • Includes one Inspector, two Judges, two Clerks and two Sheriffs.
  • Challenger, Poll Book Holder and Poll Watcher may be at each polling place.

 

 

IOWA

 

STATE OFFICES:

STATE COMMISSIONER OF ELECTIONS-

  • Secretary of State, elected for four year term.
  • establishes uniform election practices used throughout the state.
  • prescribes necessary forms required to conduct elections.
  • exercises general supervisory powers over County Commissioners of Elections.

STATE VOTER REGISTRATION COMMISSION-

  • composed of the Secretary of State , the State Chairperson of each of the two major parties, and a person appointed by the President of the County Auditors Association.
  • makes and reviews policy regarding voter registration.
  • prescribes forms required for voter registration.

STATE REGISTRAR OF VOTERS-

  • regulates preparation, preservation and maintenance of voter registration records.

STATE BOARD OF CANVASSERS-

  • composed of the Governor, Secretary of State, state Auditor, state Treasurer, and Secretary of Agriculture.
  • canvasses abstracts of votes cast for all state and federal offices except Governor and Lt. Governor.

BOARD OF EXAMINERS FOR VOTING MACHINES AND ELECTRONIC VOTING SYSTEMS-

  • three members appointed by the State Commissioner of Elections for six year terms.
  • must approve all voting machines/systems before use.

 

LOCAL OFFICES:

COUNTY COMMISSIONER OF ELECTIONS-

  • County Auditor, elected for a four year term.
  • conducts county voter registration.
  • appoints Precinct Election Boards.
  • furnishes election supplies to precincts.
  • prints ballots.
  • trains local election officials.
  • administers absentee voting.

COUNTY BOARD OF SUPERVISORS-

  • conducts vote canvassing at the local level.

  • receives initiative and referendum applications and certifies or denies applications.
  • makes copies of state election code available to County Clerks and local election officials.
  • issues certification of nomination to winners in statewide primaries.

STATE CANVASSING BOARD-

  • composed of the Governor, Secretary of State, State Auditor and State Treasurer.
  • reviews abstracts prepared by Secretary of State and certifies them as the official state canvass.

 

LOCAL OFFICES:

COUNTY CLERK-

  • elected for four year term.
  • furnishes voter registration forms to registry agents.
  • administers absentee registration and voting.
  • provides all election supplies to local officials.
  • prints all ballots.
  • provides instruction cards on ballot preparation for elections.
  • appoints Judges of Election and Counting Boards for each polling place.

COUNTY CANVASSING BOARD-

  • composed of the County Clerk and one member of each major party appointed by County Commissioners.
  • reviews and certifies abstracts of county vote.

BOARD OF COUNTY COMMISSIONERS-

  • adopts all voting machines/systems meeting state statutory specifications.

 

ELECTION DAY OFFICERS:

JUDGES OF ELECTION-

  • at least three Judges per precinct appointed by the County Clerk for two year term.

COUNTING BOARDS-

  • three or more members appointed by County Clerk from lists submitted by the county Chairpersons from the two major political parties for two year term.
